Shipping Protection

These are the terms and conditions for PUSHAS Shipping Protection — an optional service for orders shipped within Australia, added at checkout.

PUSHAS Shipping Protection is not an insurance product. It is an optional service provided by PUSHAS Pty Ltd (ABN 64 617 810 554). By adding Shipping Protection to your order at checkout, you agree to these terms.

What’s included

PUSHAS Shipping Protection applies to orders shipped within Australia where one of the following is true:

  • The carrier has formally declared the shipment lost; or
  • The order has not been delivered within thirty (30) days of dispatch.

What’s excluded

  • Orders shipped outside Australia.
  • Orders where tracking shows the parcel was delivered, regardless of whether the parcel was received (including theft after delivery or “porch theft”).
  • Damaged items (refer to the carrier’s process and your rights under Australian Consumer Law).
  • Orders within the first thirty (30) days after dispatch, unless the carrier has formally declared the shipment lost.
  • Incorrect or incomplete delivery addresses provided at checkout.
  • Orders refused, returned to sender, or unclaimed at a collection point.
  • Delays caused by customs, weather events, carrier industrial action, or other events outside PUSHAS’s reasonable control.

Eligibility period

Requests may be submitted from thirty (30) days after dispatch, or earlier if the carrier has formally declared the shipment lost. Requests must be submitted within ninety (90) days of dispatch.

Resolution

Where PUSHAS agrees the order is eligible under these terms, PUSHAS will provide one of the following (replacement subject to stock availability):

  • A replacement of the original item; or
  • Store credit equal to the order value plus an additional 10%, up to a maximum of AUD $800 per order.

Store credit does not expire and can be used on any order at pushas.com.

If PUSHAS determines the order does not meet the eligibility criteria in these terms, the request will be declined and the reason will be communicated to the customer.

Refund of the Shipping Protection fee

The Shipping Protection fee is refunded in full if:

  • The order is cancelled before dispatch; or
  • The order is refunded in full for any reason before dispatch.

Once the order has been dispatched, the Shipping Protection fee is non-refundable, including where an eligible request for replacement or store credit is approved.

Your consumer rights

Nothing in these terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law or any other applicable consumer protection laws. These terms apply in addition to those rights. If you believe your rights have been breached, you may contact the Australian Competition and Consumer Commission (ACCC) or your state or territory consumer affairs body.

Fraud and misuse

PUSHAS reserves the right to decline any request where it reasonably believes the request is fraudulent, duplicative, or where the service has been misused.

Privacy

Any personal information you provide in connection with Shipping Protection (including through a replacement request) is handled in accordance with the PUSHAS Privacy Policy.

Changes to these terms

We may update these terms from time to time. The terms that apply to your order are those published at the time your order was placed.

Governing law

These terms are governed by the laws of New South Wales, Australia. Any dispute in connection with these terms is subject to the non-exclusive jurisdiction of the courts of New South Wales.
